  • Engineering Insurance, Bonding, and Surety

    PDH Course Description:

    This course equips U.S. engineers with the vocabulary, structures, and decision tools to align project contracts with insurance and surety instruments that actually work at claim time. Participants build a working command of CGL, professional liability, builders risk, workers’ compensation, auto, pollution (CPL/PLL), and specialty endorsements (AI/PNC/waivers), and learn how these coverages interact with AIA/EJCDC terms, delegated design, design-build, and public-work bonding requirements. The course balances statutory anchors (e.g., Miller Act, FAR, CERCLA/RCRA, TSCA), current market practice, and practical workflows for notice, tender, ADR, and AIA A312 bond claims.

    Across the course and worked case studies, engineers practice translating contract requirements into policy language and evidence (endorsements, not just certificates), avoiding uninsurable promises, and preserving remedies through disciplined documentation. Environmental and international modules address PFAS/NPDWR developments, MCS-90 transportation overlays, Controlled Master Programs (DIC/DIL), on-demand guarantees, export controls (EAR/ITAR), sanctions screening, and GDPR/UK data-transfer tools so multidisciplinary teams can deliver confidently in both domestic and cross-border settings.

    By the end of this course, participants will be able to:

    • Distinguish surety bonds from insurance and map bid/performance/payment bonds to contract triggers and AIA/EJCDC workflows.
    • Interpret CGL, umbrella/excess, and professional liability insuring agreements, exclusions, conditions, and endorsements in project context.
    • Specify and verify additional insured, primary/non-contributory, and waiver-of-subrogation requirements with the correct ISO forms and evidence.
    • Align delegated design and design-build obligations with bond rights, professional liability, and subcontractor risk controls (including SDI vs subcontract bonds).
    • Structure property/inland marine programs (builders risk, installation, equipment) and coordinate them with wrap-ups and project delivery.
    • Plan and execute notice and tender strategies (own policy and additional-insured tenders), manage reservation-of-rights, and navigate ADR timelines.
    • Evaluate environmental exposures and select CPL/PLL, transportation/NODS, and auto endorsements; integrate PFAS, CERCLA, and stormwater requirements.
    • Apply claims-made mechanics (retro dates, ERP/tails) for design firms, PSPL/OPPI for large projects, and rectification coverage in contractor-led delivery.
    • Manage international risk using Controlled Master Programs (local admitted + DIC/DIL), on-demand guarantees/URDG, Incoterms®-aligned cargo cover, and export/sanctions/data controls.
    • Build an end-of-project checklist for waivers, correction periods, statutes of repose, surety releases, and ERP/tail purchases.
